(1)
This Act is binding on Her Majesty in right of Canada or a province.
(2)
In addition to its application in Canada, this Act applies to vessels and aircraft outside Canada that are registered in Canada.
(3)
This Act does not apply to the extent that its application is excluded by a regulation made under paragraph 27(1)(e) or by a certificate issued under section 31.
(4)
This Act does not apply in relation to
(a)
any activity or thing under the sole direction or control of the Minister of National Defence, including in circumstances in which the regulations provide that it is under that Minister’s sole direction or control;
(b)
commodities transported by a pipeline governed by the Canadian Energy Regulator Act, the Canada Oil and Gas Operations Act or the law of a province; or
(c)
dangerous goods confined only by the permanent structure of a vessel.

(1)
La présente loi lie Sa Majesté du chef du Canada ou d’une province.
(2)
La présente loi, en plus de s’appliquer au Canada, s’applique aux bâtiments et aux aéronefs qui ne se trouvent pas au Canada mais qui y sont immatriculés.
(3)
La présente loi ne s’applique que dans la mesure où un règlement pris en vertu de l’alinéa 27(1)e) ou le certificat délivré en vertu de l’article 31 n’en exclut pas l’application.
(4)
Elle ne s’applique pas non plus :
(a)
aux activités ou choses sous la seule responsabilité du ministre de la Défense nationale ou sous sa maîtrise effective, notamment dans les circonstances prévues par règlement;
(b)
au transport de produits par des pipelines régis par la Loi sur la Régie canadienne de l’énergie, la Loi sur les opérations pétrolières au Canada ou une loi provinciale;
(c)
aux marchandises dangereuses contenues seulement par la structure permanente du bâtiment.
